4.1. Our Privacy Policy sets out how we collect and use personal data. We process all data in accordance with UK GDPR and other applicable data protection laws.
5. Third-party content and links
5.1. We are not liable for third-party content on the site, such as comments or advertisements.
5.2. Links to external websites or content are for your convenience. We do not monitor or endorse third-party content and accept no responsibility for its accuracy or reliability.
6. Voucher and Product Terms of Sale in the UK
6.1. General Information
- These Terms of Sale apply to every Voucher or Item purchased through our site.
- A Voucher entitles the holder to receive goods/services (the "Merchant Offering") from the Merchant as described.
- We act as an introducer working on a commission basis. The Merchant is responsible for the Merchant Offering.
6.2. Fraud Prevention
We reserve the right to reject or cancel orders if fraud is suspected.
6.3. Redemption
Vouchers can only be redeemed with the Merchant during the validity period. We are not responsible for expired or unused vouchers.
6.4. Use of Vouchers
Vouchers are non-transferable, and you are responsible for their safekeeping.
7. Product Sales
7.1. You are purchasing products from Merchants. Your purchasing contract is with them, and we simply facilitate the sale.
7.2. We are not liable for product fitness, usability, or completeness. Returns are governed by the Consumer Protection (Distance Selling) Regulations 2000.
8. Liability
8.1. We are not liable for any dealings you have with Merchants or other third parties. We cannot be held responsible for unforeseeable losses, technical issues, or events beyond our control.
8.2. We do not guarantee that the site will be free of errors or viruses.
8.3. Nothing in these Terms limits liability for death or personal injury caused by negligence or fraud.
8.4. Use of the Site: We make no guarantees about the functionality, performance, or availability of the site. 9. Charity Donations
9.1. All donations are made by iBuytoGive Limited. If a chosen charity does not accept a donation, it will be redirected to another charity of our choice.
10. Termination of Accounts
10.1. We reserve the right to terminate accounts at any time for any reason.
11. Validity of these Terms
11.1. If any provision is found unlawful or unenforceable, the remaining provisions remain valid.
12. Applicable Law and Jurisdiction
12.1. These Terms are governed by English law. The English courts have exclusive jurisdiction over disputes arising from these Terms or your use of the site.
13. Product Liability
13.1. Product Liability: We act solely as a facilitator of sales. The responsibility for the quality, safety, and fitness of products lies solely with the Merchant. iBuytoGive Limited cannot be held liable for injury, damage, or loss arising from the use or misuse of any products purchased via the site. Buyers are advised to carefully review product descriptions and Merchant warranties before purchasing.
14. BuytoGive Refund Policy
14.1. Introduction
BuytoGive.co.uk is a marketplace that connects customers with independent sellers. As such, each seller is responsible for setting their own refund and returns policy, in compliance with UK consumer laws. Some items, such as perishable goods (e.g., food) and personal-use items (e.g., underwear), may not be eligible for return or refund unless they are faulty. This policy outlines the role of BuytoGive.co.uk in facilitating refunds and returns, as well as our authority to intervene when necessary.
14.2. Customer Rights and Seller Responsibilities
Each seller on BuytoGive.co.uk must provide a clear and transparent refund policy in line with UK legislation, including but not limited to:
- The Consumer Rights Act 2015, which ensures that all goods must be of satisfactory quality, fit for purpose, and as described.
- The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which grants consumers the right to cancel online purchases within 14 days of receiving their goods, except for certain exempt items.
- The Electronic Commerce Regulations 2002, which require clear communication of seller details and terms of sale.
By selling on BuytoGive.co.uk, all vendors explicitly agree to abide by these UK consumer laws and adhere to our marketplace terms. It must be noted that before a vendor can list and sell products on BuytoGive.co.uk, they must agree to this refund policy and all related terms. Failure to comply may result in action, including but not limited to the suspension or removal of their store from the platform.
Customers have the right to contact sellers directly regarding refunds or returns. The seller must handle all requests fairly and within a reasonable timeframe. Vendors must offer a return for a full refund if a customer notifies them within 14 days of receiving their goods that they wish to cancel, and the items are eligible.
14.3. How to Request a Refund or Return
If you wish to return an item or request a refund, you should first contact the seller directly using the contact information provided on their store page. The seller will guide you through their returns process and inform you of any conditions or timeframes that apply. Sellers must respond to refund or return requests related to faulty or misdescribed items within 48 hours. If a seller fails to respond within this timeframe, BuytoGive.co.uk may intervene.
14.4. BuytoGive’s Role
While BuytoGive.co.uk does not handle refunds directly, we facilitate communication between buyers and sellers to ensure a smooth resolution process. In cases where a dispute arises or a seller fails to act in accordance with their stated refund policy, BuytoGive.co.uk reserves the right to step in and make a final decision.
14.5. Dispute Resolution
If a refund or return request is not resolved satisfactorily between the buyer and the seller, BuytoGive.co.uk may intervene under the following conditions:
- The customer has made reasonable efforts to contact the seller without success.
- The seller is in breach of their own stated refund policy or UK consumer protection laws.
- There is evidence that the item received was faulty, not as described, or otherwise misrepresented.
Customers may escalate a dispute to our customer services department, who will issue a support ticket to track responses between the customer and the vendor. BuytoGive.’s decision will be final, and we may process a refund on the seller’s behalf where necessary.
14.6. Refund Processing
Sellers have the authority to issue refunds directly. However, as part of our marketplace agreement, BuytoGive.co.uk also holds the authority to process refunds through the seller’s payment gateway if required. Refunds will be processed within 5-10 working days from the date they are approved, subject to any applicable processing times set by the payment provider.
14.7. Return Shipping Costs
- Sellers must cover the return shipping costs for items that are faulty, misdescribed, or not as advertised.
- If a customer returns an item for reasons unrelated to fault or misdescription (e.g., change of mind within 14 days), they may be responsible for covering the return shipping costs, in line with the seller’s individual policy.
14.8. Non-Refundable Items
The following items may not be eligible for return or refund unless faulty or misrepresented:
- Perishable goods such as food and beverages
- Personal-use items such as underwear, swimwear, and hygiene products (if unsealed)
- Custom or personalised products unless defective
- Digital downloads and software once accessed or downloaded
14.9. Changes to This Policy
BuytoGive.co.uk reserves the right to update this Refund Policy at any time to reflect changes in UK consumer law or marketplace operations. Customers and sellers will be notified of significant changes.
